2016 Chair Covers/Sashes/Accessories/Artificial Flowers Etc - Hire - Terms and Conditions


1.0 Definitions

1.1 "The contract" means the documents that set out these conditions and all othe details about your agreement with us.

1.2 "We", "Us", "Owner" and "Our" mean the supplier of the goods, i.e. Dylandco Limited.

1.3 "You", "Your", and "Hirer" mean the hirer of the goods.

1.4 "Goods" means all good(s) hired by us to you.

2.0 General

2.1 Paragraph headings are inserted for convenience only and do not define limit or otherwise affect the interpretation thereof.

2.2 All goods remain the property of the owner.

2.3 We reserve the right to use photography of event(s) for promotional purposes unless otherwise advised by the hirer.

3.0 Conditions Applicable

3.1 The contract for the hire of goods is between the owner and the hirer, not to the venue, unless goods are being hired by directly by the venue.

It is the hirers responsibility to ensuer that the venue is clearly instructed so that the terms and conditions are met.

The owner will charge the hirer for any costs due to the terms and conditions being broken.

It is the responsibility of the hirer to reclaim any of these costs from the venue, if the venue was at fault.

3.2 We reserve the right to change these terms and conditions with immediate effect.

Only the latest terms and conditions will be applicable to the hirer at all times.

Changes will be identified by a sequential numerical update of the terms and conditions revision number.

The latest terms and conditions will be available on the website.

It is the hirer's responsibility to be aware of the terms and conditions applicable to him/her at the time of hire.

A copy of the latest terms and conditions can be requested at any tme by the hirer.

3.3 These conditions exclude any terms and conditions you may have put forward, except where we have agreed to any amendments or other conditions in writing.

4.0 Prices/Booking Fee and Security Deposits

4.1 Prices quoted are for one day hire only apart from the day of delivery and collection.

Susequent day(s) will be charged at a daily rate unless a special agreement has been arranged prior to to the event between the owner and the hirer.

4.2 Prices and availability of goods are subject to change without notice. However, once a booking fee is paid, the price quoted will not change. A quote given over the phone or by email may change up until a booking fee is paid to secure the booking.

4.3 A refundable security deposit will be included and payable with the final invoice.

The refund of the security deposit will be completed no later than 30 days following the end of the goods hire period.

Any amount to be refunded will be calculated taking into account any charges owed to us (see below for details of all deductable charges).

5.0 Bookings and Cancellations

5.1 A none refundable booking fee of £250 of the full amount including delivery/setup/collection charges (not security deposits) is required to complete your booking.

Booking requests can be made by email, telephone or via the enquiry form on our website.

Bookings won't be confirmed and as such the corresponding date(s) not reserved until the booking fee or full invoice amount has been paid.

5.2 Bookings alterations will be accepted up to 4 weeks prior to the event taking place, depending on availability.

Change requests by the hirer will need to be done so in person, in writing, by email or via the enquiry form on our website. If acceptable, we will acknowledge the changes to the original booking with issuing a revised quotation within 7 days.

5.3 Final quantity requirements must be advised no later than 4 weeks prior to the event taking place.

5.4 Final payment is required in full 4 weeks prior to the event. Please note if final payment is not recieved within the terms and conditions of payment, we will presume that our services are no longer required and a further additional cancellation charge of 25% of the full amount including delivery/setup/collection charges(not security deposits) will be retained.

5.5 We can accept last minute orders depending on availability

A none refundable full cash payment is required at the time of booking for additional orders required within 4 weeks.

5.6 Booking(s) can be cancelled in writing or by email by the hirer up to 14 days after confirmation of booking (as stated on the invoice). Any monies paid will be refunded in full.

Cancellations made thereafter will atract a cancellation charge levied by the owner.

Cancellations will be acknowledged in writing or by email by the owner within 7 days.

5.7 If we have to cancel a booking due to reasons beyond our control, we will do so in writing or by email, returning any monies paid.

5.8 No refund will be made as a consequence of any booking alterations made by the hirer within 4 weeks of the event.

6.0 Payments and Refunds

6.1 We offer the following methods of payments:

Cash - Card - Bank Transfer.

6.2 Refunds due following a booking cancellation will be calculated on a tier basis as follows:

Up to 4 weeks prior to event: 50% of the total booking value (including booking fee but not including security deposits)

Under 4 weeks prior to the event: No Refund

6.3 Any refund due to the hirer will be paid within 30 days of the acknowledgement cancellation date by us.

If a refund cannot be processed by us because of missing information on your part, a limit of 30 days from your cancellation request will be applicable after which any refund due will be forfeited.

7.0 Delivery/Set up and Cancellation

7.1 Delivery only: Goods are delivered normally the day before the event and collection normally the first day following the event, unless otherwise specified.

7.2 It is the hirer's responsibility to ensure that he/she or his/her representative is present at the date and time(s) agreed to accept the delivery. The owner will not accept responsibility for delayed or aborted delivery caused by the absence of the hirer or his/her representative on the date and time(s) agreed.

7.3 On delivery, the hirer or his/her representative shall inspect the goods and sign the delivery note.

7.4 In the event of a shortage and/or damage, the hirer or his/her representative shall endorse the delivery note accordingly at the time of delivery. If the hirer or his/her representative fails to perform any of his/her obligations under this condition, any goods will be deemed to have been delivered in a satisfactory condition.

7.5 Set Up: Goods are delivered and set up is normally carried out on the day of he event unless otherwise specified.

7.6 It is the hire's responsibility to ensuer that he/she or his/her representative is present at the date and time(s) agreed to accept the goods and set up.The owner will not accept responsibility for delayed or aborted set up caused by the absence of the hirer or his/her represenative on the date and time(s) agreed

7.7 In the event of shortage and/or damage or unsuitable set up, the hirer or his/her representative shall endorse the delivery note accrdingly at the time of delivery and set up. If the hirer or his/her representative fails to perform any of his/her obligations under this condition, any goods and set up will be deemed to have been delivered and set up in a satisfactry condition.

7.8 Collection only: Goods must be available for collection normally the day after the event at the delivery address unless otherwise arranged. All collections including aborted collections will be charged for.

7.9 Goods must be packed in the boxes or packaing they were delivered in if no set up is required. If there is more than one box, the items should be divided equally between the boxes.

7.10 In order to prevent mildew damage, wet goods must be place in plastic bags. Goods attacked by mildew will be chargeable at their full replacement cost.

8.0 Shortage and Damages

8.1  Shortages and/or damages to the hired goods will be charged at their full replacement value, details of which are available on request. No substitute item will be accepted by the owner.

Damages include but are not limited to:

Chair covers/Sashes/Linen:dragged on the floor, burns, holes, rips and tears, candle wax, grease and deep staining.

Please note that chair covers will not be allowed for use outside unless prior agreement between the owner and the hirer has been made. It is the responsibility of the hirer to ensure that the chair covers are not used outside regardless of any other party's involvement, i.e. venue, venues event coordinator, etc

Glassware: chipped or broken item, missing parts(s), etc.

Others:  Chipped or broken item, burns (either partially or fully), bent, deep scratch(es) , missing part(s), etc.

Artificial flowers: missing, damaged, burnt, etc.

8.2 The owner will inform the hirer within 30days in writing of any damages and costs concerning any of the hired goods. An invoice will be sent outlining amount and type of damage with associated chargeable costs.

8.3 The hirer may request in writing the return (and bear the cost thereof) of any damaged goods within 14 days of the hirer being informed in writing of any such damage. Otherwise the said items will be disposed of.

8.1 If goods are not returned at the end of the agreed hire period, the owner retains the right to charge for:

8.4.1 The full cost of replacement of goods to honour any bookings where the goods are required.

8.4.2 The cost of replacement of goods where hired goods are permanently not returned.

8.4.3 An additional hire period, charge at the item(s) daily rate.

8.4.4 Additional collection charge(s) (courier, pick up, etc).

9.0 Liabilities

9.1 During the period of hire, the hirer shall be solely responsible for the hired goods.

The hirer shall alone be responsible for the goods from the time of acceptance of goods until return and acceptance of goods back into the possession of the owner.

9.2 It is the hirers responsibility to ensure thet the venue does not change or intend to change their chairs/tables or layout prior to the event taking place.

We shall not be liable for incorrect chair or table cover fitting as a result of any changes made by the venue between the time of booking and the event taking place.

9.3 We will not be liable for our incapacity to hire all or part(s) of the booking item(s) as a consequence of a date and/or venue change made by the hirer.

9.4 It is the hirer's responsibility to notify us as soon as possible of any date and/or venue change.

9.5 We will endevour to facilitate this change based on our availabilityat the time of your notification to us.

9.6 Please be aware that extra charge(s) may be applicable.

9.7 If as a consequence of the date and/or venue change, we cannot provide you with the service originally contracted, the booking will automatically be cancelled and our refund conditions will be applicable.

9.8 The owner shall not be responsible for injury or damage to person or property howsoever sustained, arising from any goods under hire.

9.9 We shall be under no liability in respect of any defect arising from willful damage, abnormal usage conditions, alteration or repair of the goods without our prior approval.

9.10 We will not be liable for any indirect loss, loss of business, profits, savings you expect to make, wasted money, fees or expenses, wages, due to late collection/delivery, non-delivery, non-collection, unsuitability, breakdown or stoppage of the goods or any part of them.

9.11 We will not be liable for any delays caused by any circumstances beyond our control.

10.0 Rights Reserved

10.1 Any failure by us to enforce any or all of these conditions shall not amount to or be interpreted as a waiver of any of our rights.
